These Terms of Service ("Terms") govern your access to and use of the Powerbuilt Labs website at powerbuiltlabs.com (the "Site") and the purchase of any products offered through the Site. By accessing the Site or placing an order, you agree to be bound by these Terms. If you do not agree, you must not use the Site or purchase products from us.
1. Research Use Only
All products sold by Powerbuilt Labs are intended strictly for laboratory research use by qualified researchers in a controlled laboratory setting. Products are not for human or veterinary consumption, ingestion, application, injection, or in vivo use of any kind. Products are not drugs, food, dietary supplements, or cosmetics, and have not been evaluated or approved by the FDA, EMA, or any other regulatory body. By purchasing from us, you represent and warrant that you are a qualified researcher purchasing for lawful research purposes only.
2. Eligibility
You must be at least 21 years of age and a legal resident of the United States to purchase from Powerbuilt Labs. By placing an order you affirm that you meet these requirements and that all information you provide is true and accurate. We reserve the right to refuse service, cancel orders, or terminate accounts at our discretion.
3. Orders & Payment
All orders are subject to acceptance and product availability. We accept credit and debit cards (Visa, Mastercard, American Express), Apple Pay, Google Pay, instant bank transfers (ACH), cryptocurrency, Zelle, and Cash App. All payments are processed automatically and securely at checkout. Prices are listed in U.S. dollars and may change at any time. We reserve the right to correct any pricing or product description errors and to cancel any order placed based on inaccurate information.
4. Shipping
Orders placed before 3pm CT Monday through Friday ship the same business day. Orders placed after 3pm CT, on weekends, or on U.S. federal holidays ship the next business day. We are not responsible for delays caused by carriers, customs, weather, or events outside our reasonable control. Title and risk of loss pass to you upon delivery to the carrier.
5. Returns & Refunds
Due to the nature of research compounds, we do not accept returns of opened products. If your order arrives damaged or contains a discrepancy, contact us within 48 hours of delivery at [email protected] and we will resolve the issue. 6. Use of the Site
You agree to use the Site only for lawful purposes and in a manner that does not infringe on the rights of others or restrict their use of the Site. You may not attempt to gain unauthorized access to any portion of the Site, the servers on which it is hosted, or any related systems. You may not interfere with the proper functioning of the Site or use it to transmit malicious code, spam, or unsolicited communications.
7. Account Security
If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect unauthorized use of your account.
8. Intellectual Property
All content on the Site — including text, graphics, logos, product photography, lab reports, and software — is the property of Powerbuilt Labs or its licensors and is protected by U.S. and international copyright and trademark laws. You may not reproduce, distribute, modify, or create derivative works from any content on the Site without our prior written permission.
9. Disclaimers
THE SITE AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. We do not warrant that the Site will be uninterrupted or error-free, or that any product will meet your specific research requirements. Any reliance on the products or information provided is at your own risk.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, POWERBUILT LABS, ITS OFFICERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE OR ANY PRODUCT PURCHASED FROM US, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM.
11. Indemnification
You agree to indemnify, defend, and hold harmless Powerbuilt Labs and its officers, employees, and affiliates from any claims, losses, damages, liabilities, or expenses (including reasonable attorneys' fees) arising out of your breach of these Terms, your misuse of any product, or your violation of any applicable law or regulation.
12. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Site shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) in Houston, Texas, in accordance with the AAA Commercial Arbitration Rules. You waive any right to participate in a class action.

We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.
